Failure to Appear (FTA)

If you have received a speeding or other traffic ticket, the worst thing you can do is ignore the citation. If you miss a court date for a traffic citation, you will be considered in "failure to appear" status and a bench warrant may be issued for your arrest. Your driver's license may also be suspended in conjunction with your failure to appear (FTA) status. Fortunately, you may be able to avoid further penalties and you may be able to have your driver's license reinstated.  If you receive a FTA notice or know you failed to appear on your court date you should contact an attorney immediately.

Scheduling an appearance before a judge at a Failure to Appear (FTA) hearing will be necessary if you missed your court date.  An experienced and knowledgeable lawyer can help with these matters by scheduling your hearing for you, fully preparing for the hearing and then presenting your case at the hearing to seek a positive result. These are legal proceedings and therefore must be approached properly - and quickly - if you are to have the opportunity of avoiding additional fines, suspenisons and penalties.

License Suspension for a Failure to Appear

According to Georgia Code, a driver may face suspension of his/her drivers license for a failure to appear in court after receiving a traffic citation for any type of traffic violation other than a parking ticket. If your license was suspended, you will need to get a license reinstatement form or clearance letter from the court and take this to your local Department of Driver Services (DDS) to have your driving privileges reinstated. In addition to bringing the proper paperwork, you will be required to pay a reinstatement fee. Only the DDS has the authority to reinstate your license.

Handling a failure to appear situation and getting your license reinstated can be a complex and difficult matter to address. With the proper knowledge of the law and understanding of the Court procedures help from David A. Lipton can mean difference between a long suspension of your driving privileges and reinstatement of your license.
